He said Eddins and Houston had met earlier at a party and went to the trailer located in the Village Springs community. Eddins was stabbed in the chest during an argument.

Beason to Propose Legislation to prevent Gas Price Gouging
09/20/08
Submitted by Chris Brown for
Senator Scott Beason
On September 19, in response to the events that occurred prior to the landfall of Hurricane Ike in Texas, when Alabamians saw gas prices rise to levels higher than most states in the nation, Senator Scott Beason proposed sponsoring legislation to prevent fuel retailers and suppliers from price gouging prior to the declaration of a state of emergency.
“After a week of letting the dust settle, it is apparent that motor fuel supplies were not drastically affected by the onslaught of the hurricane, but Alabamians paid hundreds of thousands of dollars extra for gasoline because some suppliers and retailers took advantage of the situation,” Beason said.

“There already is a system in place to control the increase of fuel prices during a declared state of emergency, but drastically raising fuel prices based on what ‘might’ happen is unconscionable. There needs to be a mechanism in place to prevent the artificial inflation of fuel prices that cause consumer panic. The urgency caused by the oil companies creates a self-fulfilling prophecy of fuel shortages and even higher prices,” Beason stated. “A free and open market does not exist during volatile situations, and those who would exploit people’s fears for a profit should be prosecuted.”
“I am proposing that the Governor of Alabama be given the authority to call a three day ‘State of Preparedness’ to protect the citizens of Alabama from fuel price gouging when our state will be indirectly impacted by natural disasters in other states. The Attorney General should also be given the power to prosecute violators during a ‘State of Preparedness,” Beason continued.
“People depend on gasoline and diesel fuel for travel so they can provide for their families. I will sponsor legislation that will protect all Alabamians from fuel related price gouging during the period before a forecasted disaster, not just during a full state of emergency.”
“This proposal will only affect those fuel suppliers and retailers that raise prices based on short term speculation, not those who change prices after there has been an impact on our oil resources because of a natural disaster.” Beason concluded.
Senator Beason represents portions of Jefferson, Blount and St. Clair Counties.

9/19/08
3:09PM
By Cathy Leslie
City Council members voted to adopt an Ordinance at the September 18 meeting, concerning the operation of Bingo in the City of Pinson in accordance with Alabama Act No. 80-609 concerning the operation of Bingo in Jefferson County.
The Bingo Ordinance states in part; according to the Constitution of Alabama the operation of bingo games for prizes or money by nonprofit organizations for charitable or educational purposes are legal in Jefferson subject to certain provisions of an ordinance by the governing bodies of the cities and towns.  It shall be unlawful for any person or group to administer, operate or offer Bingo within the City of Pinson through use of any Electronic device in which the device would allow Bingo players to participate in a Bingo game with no human players.  It shall be unlawful for any person or entity to administer, operate or offer Bingo within the City unless a permit has been secured from the Sheriff.
According to Councilor Joe Cochran, the city is basically agreeing with and adopting the State laws regarding Bingo in Jefferson County.  Cochran said, “Anyone wishing to open a Bingo establishment in the city of Pinson must first obtain a permit from the Jefferson County Sheriff.
Lt. Randy Christian was asked if the Sheriff was issuing Bingo permits at this time.  He said, “The District Attorney gave the Sheriff an opinion after reviewing the Bingo Amendment specific to Jefferson County saying that the Sheriff didn’t have the authority or responsibility to issue Bingo Permits so no we are not. In the D A's opinion that responsibility and authority lies with the County Commission.

Office of Commission President Bettye Fine Collins
9/16/08
5:10PM

Jefferson County has just been served with a legal action in the United States District Court with the Bank of New York Mellon as Trustee and Financial Guarantee Insurance Company and Syncora Guarantee, Inc. (XL Capital Assurance, Inc.) as Plaintiffs.  The suit asserts that the Plaintiffs are entitled to have  Receiver placed in control of the Jefferson County Sewer System with the right to impose sewer rate increases and other sewer revenue enhancement measures that may be available to the County Commission.  The County will assert its rights and defenses which will include the fact that neither additional sewer rate increases or other sewer revenue enhancements are legally available to the County Commission.  The County Attorney emphasizes that any such Receivership applies only to the Sewer System and does not affect the rest of the County.  County Commission President Bettye Fine Collins expressed regret that the bond insurers had chosen to pursue this litigation after the parties had been working for months to find a settlement.  She has referred all other questions to the County’s Attorneys.

Wayne’s Angles Gymnastics comes to an end
9/08/08

Coach Wayne Stough and wife Helen have been teaching gymnastics in Pinson for 35 years, the first year was taught at the Rock School then 34 years being at Pinson Elementary.  It came to an end at after the 07/08 school year when Stough said he learned that once construction began on the elementary school he would no longer have access to the gym.  Since this was prior to taking his girls to Nationals at the Wide World of Sports in Orlando, one last time in July he needed a place to continue practicing.  Stough said he was thankful to Principal Whitehurst when she agreed to allow the team to use the gym at Rudd Middle School the month of June in preparation for Nationals.
Pinson Elementary’s Principal Ritchey was asked about the situation. She said, “Unfortunately Coach Stough will not be unable to use our gym because we no longer have a storage area for all of his equipment. The gym is now enclosed within the school and night time security is also an issue.”

Stough said at the age of 71 he was prepared to retire but after receiving numerous phone calls and visits from parents who are not ready for Wayne’s Angels to end he began looking for a church gym or another facility in the Pinson area to resume gymnastics that include the beam, bars, vault and tumbling.  If you know of a church or another facility to continue the Wayne’s Angel tradition contact Coach Wayne Stough at 681-6832.

Wayne and Helen Stough will have been married 50 years in December.

AYP Reports now out
August 4, 2008
By Cathy Leslie

Adequately Yearly Progress reports (AYP) is now out for review. According to the State Board of Education the news is good for Alabama’s Title I schools (high-poverty schools that receive federal funding). Fewer Alabama public schools are identified for school improvement.  Achievement requirements continue to rise and the schools respond.
The 2008 Adequate Yearly Progress (AYP) report reveals a decrease of 18 percent in the number of Title I schools identified for School Improvement; all accomplished as schools faced increasing academic goals. Alabama is moving forward to meet the 2014 No Child Left Behind (NCLB) deadline of having all students proficient in reading and mathematics.
"We still have work to do, but our statewide programs and initiatives are making a difference in Alabama’s public schools," said State Superintendent Joe Morton. "The Alabama Reading Initiative (ARI); Alabama Math, Science, and Technology Initiative (AMSTI); and ACCESS (Alabama Connecting Classrooms, Educators, and Students Statewide) Distance Learning have proven track records in school improvement and student success. Graduation Coaches are in place in 24 pilot systems, and 38 local school systems are piloting Preparing Alabama Students for Success (PASS)," continued Dr. Morton. "Recently adopted programs such as First Choice, Credit Recovery, Credit Advancement, On-Line Learning, and Credit-Based Endorsement will further support schools, teachers, and students in Alabama."
If a school does not meet the AYP goals for two consecutive years in the same component, (reading, mathematics, attendance in elementary and middle schools, and graduation rates in high schools), it is identified for school improvement.

Candidates for City Council answer questions

July 25, 2008

In the July 25, 2008 issue of  The Pinson News, candidates for Pinson City Council answered questions pertaining to how they would proceed in working in the city if elected to the Council.  Below is a continuation of the questions and their answers that are not published in the current issue.

Listed in Place number and alphabetical order:

Place 1

Dawn Tanner (I)

I feel an open government is not only an obligation but it is the law.  The reason the Alabama Open Meetings Act no.2005-40 went into effect October 2007 was to ensure the public including the media had the right to attend and record any governmental meeting with the exception of an executive session.

2. Supporting our schools was a major issue during the inaugural city council elections four years ago. Besides donating money to our schools, in what ways do you feel you could contribute to Pinson’s education?

Contributing in Pinson’s education is to be involved with the schools.  I am involved by being a member of the Parent Teacher Association (PTA) and the Parent Teacher Student Association (PTSA) and attend the meetings.  By continuing to attend school functions like the A+ College Ready Grant program for PVHS and the Alabama Extreme Classroom Makeover at Pinson Elementary, I’ve emphasized my commitment to all the schools.

3. What do you think about Pinson taking control of the City’s property in the next year or two?

The city should be poised to assume responsibility within the next two years.  After meticulously selecting citizens for the Planning and Zoning Committee, the committees dedication to educating themselves, attending Jefferson County Planning and Zoning Board meetings, gaining a map room at the new City Hall, and learning from mistakes made by our sister city, who assumed their Planning and Zoning over too soon, the city is extremely close to being prepared for this important task.

Brad Walker (C)

8. How do you feel about open Government?

Generally speaking, I am for open government. After all, government officials are elected by the people, for the people and the people deserve accountability from those that represent them. There are a few areas such as national security and legal issues that should not be public knowledge at least for the duration of the crisis or legal dilemma. After all the dust has settled I feel the people should have access to the details of the situation so they can evaluate the work their elected officials are doing.

9. Supporting our schools was a major issue during the inaugural city council elections four years ago. Besides donating money to our schools, in what ways do you feel you could contribute to Pinson’s education?

10. What do you think about Pinson taking control of the City’s property in the next year or two?

Place 3

Cathy Leslie (C)

8. How do you feel about open Government?

Its obvious giving my line of work that I believe in “open government” as much as is allowed by law.  I also understand that there are times when Executive Sessions are needed and why the law allows them. There are only a few reasons a council enter into Executive Session; they are in part  to discuss the good name and character of a person, providing that person is given notice and is present, to discuss the discipline or dismissal of an employee or public officer, to discuss property strategy such as new business interests, litigation or law suits I have researched the Sunshine Laws and know of cities that violated how those sessions were to be run.  I believe the public should know what’s going on in their city.

9. Supporting our schools was a major issue during the inaugural city council elections four years ago. Besides donating money to our schools, in what ways do you feel you could contribute to Pinson’s education?

I think parents should be encouraged more to attend school meetings, Council Education Committee meetings and JEFCOBOE meetings, not just through council meetings but in other ways that would complement current educators.  We have several schools being revitalized, and enhanced like never before in Pinson.  But a building is only as good as the people inside. Better schools, more parent involvement brings in more homeowners that will bring in more commercial business as well as funds to the city as a whole.  I would like to see more local merchants taking part in the mentoring programs and co-op programs for our students.

10. What do you think about Pinson taking control of the City’s property in the next year or two?

I would like to see the city take over P&Z in the next year and the process has already started.  As stated in part on the city’s web site, www.thecityof pinson.com, “The residents in this city, from the Palmerdale and Pinson Valley communities, were united in the goal of local control with an overwhelming vote for incorporation. Pinson has a Planning Committee but P&Z falls to the county.  .  One of the hurdles to pass before this could happen was to have a City Hall large enough to house P & Z information, and a map room.  I suspect the process can move a little more rapidly now that we have a new city hall.
At this time, the County still has control over most streets in the city which may be to the city’s advantage, dollar wise.  I believe we must be good stewards of the city’s (mine and your’s) money so prioritizing spending is important.
Because of my knowledge of the many aspects of this city, Government, schools, business, the ball park, and people who are the heart of the city, I truly believe I am the best candidate for this Place 3.  If elected I will continue to publish information about our city and I would be in a position to help solve some issues as well.

David Meadows (C)

6. Pinson Main Street: Do you have any thoughts on how to make Pinson Main Street a place for Pinson residents to be proud of?

We must improve the appearance of Main Street.  Both residents and business owners are to be encouraged to do so.  The city could promote a ‘Main Street Cleanup Day’. I will look for grants for improving the look of Main Street.

7. Are you in favor of hiring a third Contract Deputy?

I would be in favor of that when the city’s budget is able to sustain the additional cost.  It cannot be done with one time money.

8. How do you feel about open Government?

Open Government is a fundamental right in our democracy.  Residents are encouraged to show an interest in the operation of city government.  Attending council meetings is an excellent way to do this. Sensitive issues are an exception to this:
     A.      City employee issues.
     B.      Information about possible new businesses locating here that do not work out might just be an economic decision by the      business.  These discussions could be construed as fact when it is not.
     C.      Executive sessions are just discussions and official voting, as I understand it, cannot occur.  Procedures for this are      something I must learn in a training session.

9. Supporting our schools was a major issue during the inaugural city council elections four years ago. Besides donating money to our schools, in what ways do you feel you could contribute to Pinson’s education?

The students in our schools are an important potential resource to our city, our state and our country.  As such we must see that they have a safe, healthy learning environment.  Discussions with the schools’ administrations can help focus on these issues.  We have to work in coordination with the schools. A mentoring program using residents might be a way to extend the educational resources of the schools.

10. What do you think about Pinson taking control of the City’s property in the next year or two?

If this question has to do with ‘taking control’ of planning and zoning, this is being worked on now by the council’s appointed Planning and Zoning Committee. If the “City’s property” means the streets (other than the state highways), these are, I believe, presently the responsibility of Jefferson County.  The city can ‘take control’ of the maintenance of them as funds become available.  As a civil engineer I can assist in categorizing those most in need. If the “City’s property” means the property/buildings the city owns, we already have control of these.

Shane Shelnutt (I)

6. Pinson Main Street: Do you have any thoughts on how to make Pinson Main Street a place for Pinson residents to be proud of?

I would promote the City’s involvement with the organization called Main Street USA (www.mainstreet.org).  The following information is exactly what we need to help turn our historic main street into a part of Pinson that we could all be proud of.

7. Are you in favor of hiring a third Contract Deputy?

Our current two contract deputies have done a fantastic job and when the need warrants it and the resources are available I would support an increase in law enforcement for the City.

8. How do you feel about open Government?

Having served these past four years, I have always pushed for citizen participation.  Some of the things I have led the fight in are:
(1) I introduced a motion giving citizens an opportunity to voice their opinion prior to the council vote on any agenda item.  Prior to this motion citizens could only voice their opinion to the Council in session after the fact.
 (2) I introduced a motion for posting our minutes and agenda on our website www.thecityofpinson.com  as a means for informing the public of past decisions and future discussions and possibilities.  I believe an informed citizen is a smarter citizen; therefore, any information we can get out is to the betterment of our city.
(3)  I have introduced an idea that would allow citizens to get e-mail updates of agenda items and pertinent city announcements.  (If an individual is interested, all he/she would have to do is notify the city of his e-mail address and all future notices would be sent to him/her.)
(4) During this term of Council, I have always questioned the need to enter into Executive Session.  I will continue to make sure this Council follows the intent of open government.
(5) One project that I have put a lot of time and effort behind is a request from the Education Committee to erect an electronic message board to help notify the citizens of city and education news.

9. Supporting our schools was a major issue during the inaugural city council elections four years ago. Besides donating money to our schools, in what ways do you feel you could contribute to Pinson’s education?

As a teacher myself, I would like the city council to recognize our outstanding students and teachers.  Those teachers that receive the 2nd mile award, national board certification, teacher of the year, etc. and students that receive A honor roll, A/B honor roll, 200 AR points, scholar bowl wins etc.  By focusing on academics we would show the benefits of a quality education and recognize those who teach our children.

10. What do you think about Pinson taking control of the City’s property in the next year or two?

Hopefully you and most intelligent people would want control of the city's property as soon as the city purchases it or it is donated to the city.  It is ridiculous to think that the city would wait until next year or even worse in two years to take control of city hall or any other city property.  The city would be at the mercy of a landlord who might not have the best interest of the city at heart.

Please check this weeks Pinson News for answers to the first half of their forum questions.
